2. SCOPE & APPLICABILITY
This Legal Notice governs all interactions, purchases, quotations, invoices, in-store sales, online orders, and communications with Tropical Pets KZN and Fishing Tackle (Pty) Ltd. By placing an order, making a payment, or visiting our physical store or digital platforms, you acknowledge and agree to be bound by these terms.

3. PRICING & QUOTATIONS
• All prices quoted are in South African Rand (ZAR).
• Prices are subject to stock availability and may change without prior notice.
• Formal quotations provided by Tropical Pets KZN and Fishing Tackle (Pty) Ltd remain valid for [7 days] from the date of issuance unless otherwise stated in writing.

4. PAYMENT TERMS & EFT DISCLOSURES
• Methods of Payment: Payments are accepted via Electronic Funds Transfer (EFT), approved card payment terminals, or cash.
• Payment Reference: For EFT payments, buyers must state the Invoice Number or Customer Name as the payment reference. Tropical Pets KZN and Fishing Tackle (Pty) Ltd accepts no liability for delays or misallocation resulting from incorrect payment references.
• Clearance & Fulfillment: Goods, live animals, live feeders, bait, or tackle will only be released, dispatched, or ordered once funds reflect cleared in our bank account (or upon receipt of valid, official bank-generated Proof of Payment).
• Bank Charges: Payers are responsible for all interbank transaction fees or foreign transfer charges.

5. LIVE ANIMAL & BIOLOGICAL GOODS DISCLAIMER
• Inspection on Purchase: Customers are required to inspect all live animals, fish, reptiles, birds, and live feeders prior to leaving the store or upon receipt.
• Post-Purchase Care: Tropical Pets KZN and Fishing Tackle (Pty) Ltd guarantees live animals to be in healthy condition at the time of sale. Due to external biological variables (water parameters, habitat setup, dietary changes, and handling), we cannot be held liable for illness, stress, or mortality occurring after the goods/animals have left our custody, save as mandated by the Consumer Protection Act 68 of 2008.

6. RETURNS, REFUNDS & GUARANTEES (CONSUMER PROTECTION ACT)
• Equipment & Non-Perishables: Defective manufactured equipment (filters, heaters, pumps, rods, reels) is subject to manufacturer warranties. Claims must be accompanied by original proof of purchase.
• Perishable Items & Bait: Live bait, frozen bait, live feeders, and perishable consumables are non-refundable once sold and handed over, except in cases of proven non-compliance with consumer standards at the time of sale.
• Approved Refunds: Refunds, where approved under the CPA, will be processed using the original method of payment within 14 business days.

7. PRIVACY & DATA PROTECTION (POPIA COMPLIANCE)
Tropical Pets KZN and Fishing Tackle (Pty) Ltd respects your privacy and is committed to protecting personal information processed in terms of the Protection of Personal Information Act 4 of 2013 (POPIA).
• Any personal information collected (including names, contact details, and payment proof) is used strictly for order fulfillment, invoicing, permitting support, and customer communication.
• We will not share, sell, or distribute your personal information to third parties without your explicit consent, except where required by law.

8. INTELLECTUAL PROPERTY
All promotional material, logos, brand names, flyers, images, price lists, and digital content associated with Tropical Pets KZN and Fishing Tackle (Pty) Ltd remain the intellectual property of the company. Unauthorized copying, distribution, or reproduction is strictly prohibited.

9. LIMITATION OF LIABILITY
To the extent permitted by South African law, Tropical Pets KZN and Fishing Tackle (Pty) Ltd shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the misuse of equipment, improper handling of fishing gear or live species, or reliance on information provided on marketing materials.

10. GOVERNING LAW & JURISDICTION
This Legal Notice and all commercial transactions involving Tropical Pets KZN and Fishing Tackle (Pty) Ltd shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
